Terms of Service

Welcome to DuskHeist. These Terms of Service ("Terms") govern your use of duskheist.com and any related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service is operated by Faizan Ali, a sole proprietor based in Pakistan ("we", "us", "our").

1. What DuskHeist Does

DuskHeist is an online tool that transforms photographs you upload into stylized illustrated artwork using artificial intelligence. You upload an image, choose a format and style, and the Service generates an original illustrated poster, wallpaper or cover based on your input.

DuskHeist does not host, sell or distribute any third-party artwork. All output is newly generated.

2. Not Affiliated With Any Game Publisher

DuskHeist is an independent product. We are not affiliated with, endorsed by, sponsored by, or associated with Rockstar Games, Take-Two Interactive, or any other game publisher, studio or rights holder.

References to any game, franchise or visual style on this website are descriptive only, used to help you understand the aesthetic of the artwork the Service produces. All trademarks belong to their respective owners.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service you confirm that you are 18 or older.

The Service involves uploading photographs of faces and making paid purchases, and is not designed for or directed at minors. We do not knowingly permit anyone under 18 to create an account or upload images. If we learn that a user is under 18, we will close the account and delete the associated data.

You may not use the Service if you are barred from doing so under the laws of your country.

4. Your Account

Some features require an account. You are responsible for keeping your login details secure and for all activity that happens under your account. Please notify us immediately if you believe your account has been accessed without permission.

We may suspend or terminate accounts that violate these Terms.

5. Credits and Generations

The Service operates on a credit system.

• Credits are consumed each time you generate an image, whether or not you are satisfied with the result.
• Different formats and quality levels consume different amounts of credits. The exact cost is shown before you generate.
• Credits are sold as one-time purchases. There is no subscription.
• Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.
• Free, trial and promotional credits may be limited in resolution, may be watermarked, and may be limited in number per person or per device.
• Free and promotional credits expire 7 days after they are granted. Purchased credits do not expire.

Generation is not guaranteed to satisfy you. AI output is variable by nature. Different photographs produce different results, and no two generations are identical. Credits are consumed by the act of generation, not by your approval of the result. Please see our Refund Policy for the limited circumstances in which credits are returned.

6. What You Upload

By uploading an image, you confirm that:

• You own the image, or you have the legal right and permission to upload and process it.
• The image is of you, or of a person who has given you their consent to upload their likeness and have it processed by an AI service.
• The image does not depict a public figure, celebrity, politician, or any other identifiable person who has not personally consented.
• The image does not depict a minor.
• The image does not infringe anyone's copyright, trademark, privacy or publicity rights.
• The image does not contain illegal, hateful, violent, sexually explicit or harassing content.

You remain responsible for everything you upload. We may remove content and suspend accounts that breach these rules.

7. Rights in Your Output

Subject to your compliance with these Terms and full payment, we grant you a worldwide, perpetual, irrevocable right to use, reproduce, share, print, modify and sell the images you generate with the Service, including for commercial purposes. We claim no ownership over your output and will not resell it.

An honest note on copyright: the legal status of AI-generated images differs between countries. In some jurisdictions, including the United States, material generated by artificial intelligence without sufficient human authorship may not be eligible for copyright protection at all. We grant you every right we have in the output, but we cannot and do not promise that the output is protectable by copyright in your country. If this matters to your use case, take your own legal advice.

Free-tier and watermarked output is for personal, non-commercial use only.

Our limited licence: we may display generated artwork publicly (for example in our gallery, on social media, or in marketing) only where you have explicitly opted in. We do not publish your work without your permission, and you can withdraw that permission at any time by contacting us.

8. Acceptable Use

You may not:

• Use the Service to create content that is illegal, defamatory, hateful, harassing, sexually explicit, or that depicts real violence.
• Create content that impersonates a real person, or that depicts a real person in a misleading, defamatory or harmful way. This includes public figures and celebrities.
• Attempt to reverse-engineer, scrape, overload, or gain unauthorized access to the Service, its prompts, its templates, or its underlying systems.
• Resell, sublicense or provide access to the Service to third parties without our written permission.
• Use automated tools or scripts to generate images at scale, or to create multiple accounts to obtain additional free credits.

9. Content Screening and Refused Generations

The Service relies on a third-party AI provider that applies its own content policies. A generation request may be refused, by that provider or by us, where it appears to breach those policies or these Terms.

Where a generation is refused before an image is produced, the credits for that generation are returned to your balance. You are not charged for a request that produces no output.

Repeated refused requests may result in your account being suspended.

We do not manually review the content of your uploads except where necessary to investigate a report, a suspected breach of these Terms, or a security incident.

10. Service Availability

We aim to keep the Service running smoothly but we do not guarantee uninterrupted availability. The Service depends in part on third-party providers, and may be unavailable due to maintenance, outages, or circumstances beyond our control.

We may change, suspend or discontinue any part of the Service at any time. If we discontinue the Service permanently, we will give reasonable notice and refund unused credits.

11. Pricing Changes

We may change our pricing at any time. Changes will never affect credits you have already purchased. Credits you own remain valid at the rate you bought them.

12. Payments

Purchases are processed by our online reseller Paddle.com (Paddle.com Market Limited), which acts as the merchant of record for the transaction. This means Paddle is the legal seller of record, its name will appear on your card or bank statement, and it handles billing, invoicing, receipts and applicable sales tax or VAT.

Your purchase is therefore also subject to Paddle's buyer terms. Refund handling is described in our Refund Policy.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that generated output will meet your expectations, resemble you to any particular degree, be free of errors, or be suitable for any particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law, DuskHeist and its operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or business opportunity, arising from your use of the Service.

Our total liability to you for any claim relating to the Service shall not exceed the amount you paid us in the three months preceding the claim.

Nothing in this section limits liability that cannot be limited under the law that applies to you.

15. Indemnity

You agree to indemnify and hold harmless DuskHeist and its operator from any claim, demand, loss or expense arising from your use of the Service, your uploaded content, or your breach of these Terms.

16. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access if you breach these Terms, if we suspect fraud or abuse, or if required by law. Unused paid credits may be refunded at our discretion where termination is not the result of a breach by you.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Material changes will be communicated through the Service or by email. Continued use after changes take effect means you accept the revised Terms.

18. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.

If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory consumer laws of your country of residence.
